Ms Thomas alleges she was required to adjust the height of the stand and when attempting to loosen the knob to allow the adjustment, she felt pain in her hand, wrist, elbow and shoulder.
There were various types of Mayo Stands. In her pleadings, Ms Thomas did not particularise the type of Mayo Stand involved in her incident.
Ms. Thomas applied to the Court to inspect the hospital premises and examine similar Mayo stands to gather evidence for her claim. The court ultimately dismissed her application, providing a detailed analysis of the legal and practical considerations involved.
