Protecting my client’s intellectual property in a joint venture

My client was interested in developing a joint venture with a technology partner.

The priorities were to secure the relevant background IP (contributed by each party), document the arrangements (ownership and use of newly created IP), and determine how services and management of the new business would be commercialised.

Dealing with these issues – maximising business opportunities while protecting existing rights – was complex due to the nature of the product.

Together we adopted a proactive and commercial strategy to address everything as part of the development process.

Getting the arrangements right from the start is always the best approach; and in this case, delivered a win/win solution for my client and their new joint venture partner.
